Terms & conditions

Stocks of all goods on offer are limited. O’SUN® shall take all reasonable efforts to ensure that when stock is no longer available, that offers thereof are discontinued. However, should o-sun.net be unable to fulfill any order placed by you at the advertised price due to stock having sold out, O’SUN® will notify you and you will be entitled to a refund of the amount paid by you for such product, as explained in more detail in the Refund Policy.

Price, specification, and terms are subject to change without notice. O’SUN® is not responsible for errors in typography and/or photography. Customer pays return shipping on all services.

O’SUN® accepts the following Payment Methods:

Returns

Normally we do not accept returns unless the product is defective, except in special cases with prior management approval in which case a 15% handling fee charge will apply. It is the customer's responsibility to pay for all shipping cost involved with the return of an item/order. Shipping charges will not be refunded, unless an error was made by O’SUN® in shipping. Shipping charges are non-refundable.

Processing Time

You can expect your order to be processed within approximately one to two "business" days, delivery between five and fifteen days provided the items are in stock and there are no problems with the payment verification. O’SUN® does not guarantee same day shipping. Orders will not be processed on weekends and holidays.

Back Orders

Any items that are unavailable will be placed on back order, and the remainder of your order will be shipped. You will be notified by email for the back ordered items estimated time of arrival. Please note that these dates are "estimates" and not guaranteed to arrive on that date.

Privacy

O’SUN® respects your privacy. We will not under any circumstances sell or release your information to anyone. All of the information obtained from our web site will be used for processing purposes only. The only e-mail you will receive O’SUN® are updates to any recent orders unless you have indicated otherwise in your preferences

Change Orders

Purchase Agreement

By accepting delivery of any product delivered from O’SUN, you ("The Customer") agree to be bound by the terms and conditions listed below. You and O’SUN® agree that the following terms and conditions are the exclusive terms governing the sales transaction between the Customer and O’SUN. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from O’SUN.

1. Product Return Procedure:

O’SUN® will not accept returns without prior authorization, at the discretion of O’SUN® management.

The Customer is solely responsible for shipping any returned products. The Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. The Customer agrees to bear all shipping charges and all risk of loss for the return product during shipment. The Customer agrees that all returned products will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer. If any component of the returned product is missing, O’SUN® 's Return Procedure will be breached and O’SUN® will reject the entire return or may choose to impose additional charges against the customer for replacement of the missing component.
O’SUN® will not refund the Customer the original shipping charges.

GENERAL RULE: If, within 1 months after delivery of a product to you, you find that the product is defective/faulty, unsuitable for the purpose for which it was indicated in the product description (or otherwise generally intended), not legal, or not reasonably durable (based on circumstances and product type) and you arrange to return such product to O’SUN® for inspection and the product is subsequently found to indeed be Defective, you are entitled to either (a) have the product repaired or replaced at O’SUNs expense, or (b) be fully refunded; OR NOT to be Defective, you will be liable for the costs incurred in having such product returned to O’SUN® and then re-delivered to you.
Please note that the following issues/problems will NOT render the product Defective as aforesaid and will not entitle you to any repair, replacement or refund:

IMPORTANT: you should refuse to accept delivery of any product which is visibly damaged.

2. WARRANTIES

O’SUN® warrants all newly purchased products to be completely free from any defects or faults. This warranty will be valid for a period of one year from date of purchasing from O’SUN. No responsibility will be taken for products that have been tampered with, only approved dealers may open up component parts.

3. LIMITATION OF LIABILITY

IN ALL CIRCUMSTANCES O’SUN® MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. O’SUN® SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. O’SUN® SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT O’SUN® IS APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

4. GENERAL TERMS AND CONDITIONS

Payment Terms Orders : An order is not binding upon O’SUN® until it is accepted; O’SUN® must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment

Shipping Charges : Your total cost for purchase of any product will exclude shipping and handling charges

Title & Risk of Loss : O’SUN® will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to the Customer upon delivery to the carrier. O’SUN® will advise the Customer of estimated shipping dates, but O’SUN® will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

Governing Law and Jurisdiction : Any dispute arising out of or related to these Terms and Conditions or the sales transaction between O’SUN® and the Customer shall be governed by the laws Hong Kong, without regard to its conflicts of law rules. Finally, the Customer also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against O’SUN® that is more than one year after the date of the applicable invoice.

Delivery Costs : These differ depending on a variety of factors, including product type, price, and weight, as well as whether delivery is to be made within, or outside, the borders of places of dispatch.
Delivery usually takes place within 2 or 3 weeks after dispatch, however, seasonal peaks and delays at customs is outside the control of O-sun.net and deliveries may take up to 12 weeks.

O’SUN® gladly accepts orders from all around the globe. Available product lines, shipping rates and fees may vary depending on the delivery address for your order.

Your packages may be subject to the customs fees and import duties of the country to which you have your order shipped. These charges are always the recipient's responsibility.

Import Duties : Import duties may be payable by recipients of goods in foreign countries. O’SUN® does not know what import duties/levies may be payable and cannot calculate or estimate such costs. You are responsible for determining whether any such import duties/levies are payable and, if so, the amount thereof.
When orders shipped internationally reach the destination country, they may be subject to customs clearance procedures which can cause delays beyond original delivery estimates

Limitations : For products shipped internationally, please note that any manufacturer warranty may not be valid; manufacturer service options may not be available; product manuals, instructions and safety warnings may not be in destination country languages; the products (and accompanying materials) may not be designed in accordance with destination country standards, specifications, and labeling requirements; and the products may not conform to destination country voltage and other electrical standards (requiring use of an adapter or converter if appropriate). You are responsible for assuring that the product can be lawfully imported to the destination country. When ordering from O’SUN, the recipient is the importer of record and must comply with all laws and regulations of the destination country.

All users of this Web site agree that their access to and use of this Web site are subject to the terms and conditions set forth in this legal notice and all applicable laws, and that any such access or use is undertaken at the user's own risk.
